These Terms of Service ("Terms") govern your access to and use of this website (the "Site"), operated by APEX MOTORS. By using the Site you agree to these Terms. If you do not agree, please do not use the Site.

1. Use of the Site

You agree to use the Site lawfully. You must not:

• Interfere with, disrupt, or attempt to gain unauthorised access to the Site or its systems
• Scrape, harvest, or bulk-extract content or data from the Site
• Use the Site to transmit unlawful, misleading, or fraudulent content
• Reproduce, resell, or commercially exploit Site content without our written permission

2. Vehicle Listings

Vehicle listings on the Site are provided for general information only and do not constitute an offer to sell. We reserve the right to correct errors and to change listings at any time.

• Availability, price, specifications, equipment, mileage, and condition are subject to change without notice and may contain inaccuracies
• Photographs, illustrations, and colour renderings are representative only — the actual vehicle may differ in appearance, equipment, or condition
• Descriptions may rely on information supplied by third parties, including vehicle history reports. We do not independently warrant third-party data
• Prior use, prior repairs, paintwork, and accident history may exist even where not expressly described
• Prices shown exclude taxes, title, registration, documentation fees, and any other dealer fees unless expressly stated

3. Independent Inspection

We encourage every buyer to arrange an independent pre-purchase inspection and to review all documents before completing a purchase. Used vehicles are sold "as is" unless a separate written warranty is provided. No oral statement creates a warranty.

4. Vehicle Sales

A vehicle sale is governed by a separate written purchase agreement signed by the parties, which controls in the event of any conflict with this Site. Odometer disclosure is provided as required by federal and applicable state law. Title transfer is subject to clear title and, where applicable, release of any existing lien.

5. FTC Buyer's Guide

Used vehicles offered for sale at our dealership are posted with the Federal Trade Commission Buyer's Guide, as required by the Used Motor Vehicle Trade Regulation Rule (16 C.F.R. Part 455). The Buyer's Guide is the definitive statement of warranty coverage for a specific vehicle and prevails over any general statement on this Site.

6. Service Appointments and Estimates

Service estimates given before inspection are preliminary. Additional work discovered during diagnosis requires your authorisation before it is performed. Warranty terms covering service work are provided to you in writing.

7. Shipping and Transport

If you ask us to arrange transport of a purchased vehicle, the following applies:

• Transport is performed by independent, licensed, bonded and insured carriers. APEX MOTORS acts as a coordinator and is not the carrier.
• Shipping quotes are estimates based on the information available at the time. Final cost may vary with route, fuel surcharges, access restrictions and scheduling.
• Delivery timeframes are estimates only and are not guaranteed. Weather, mechanical issues and other events may delay delivery.
• Risk of loss passes to you in accordance with the purchase agreement and the carrier's bill of lading.
• You must inspect the vehicle at delivery and note any damage on the bill of lading before signing. Transit-damage claims must be reported to us and the carrier promptly and are subject to the carrier's terms and coverage.
• Alaska, Hawaii and international shipments are subject to additional terms, fees and transit times.

8. Intellectual Property

All content on the Site — including text, layout, graphics, logos, and the APEX MOTORS name and marks — is owned by us or our licensors and is protected by copyright and trademark law. You may not use it without our prior written consent. Third-party marks are the property of their respective owners and are used for identification purposes only.

9. Disclaimers

THE SITE AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, APEX MOTORS AND ITS OWNERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

11. Indemnification

You agree to indemnify and hold harmless APEX MOTORS and its personnel from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your misuse of the Site or your violation of these Terms.

12. Governing Law and Venue

These Terms are governed by the laws of the State of Illinois, without regard to its conflict of law rules. Any dispute arising from these Terms or the Site will be brought exclusively in the state or federal courts located in Cook County, Illinois, and you consent to their jurisdiction.

13. Changes to These Terms

We may revise these Terms at any time by posting an updated version on this page. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.

14. Severability and Entire Agreement

If any provision of these Terms is found unenforceable, the remaining provisions remain in full force. These Terms, together with our Privacy Policy and any signed purchase agreement, are the entire agreement between you and us regarding the Site.
